Could Samsung Ban in United States be Overturned?

Earlier this year Apple won an unprecedented court victory against Samsung in a Californian patent dispute, in which the Korean technology giant was found to have copied Apple’s designs and infringed upon some of its design patents, and was ordered to pay the US company more than $1 billion in damages. Several Samsung devices, including several US variations of the Galaxy S and Galaxy S2, were also pulled from sale in the United States.

One of the disputed patents was regarding the “rubber band” feature, whereby the screen will “bounce back” once the user has scrolled past the end of a list. This feature was used on Apple’s iPhone and iPad but was also found on many Samsung devices running Android with TouchWiz. Apple’s claim was that Samsung had copied this design feature, which was patented by Apple, and that this along with many other copied features had led to confusion amongst customers who were subsequently unable to distinguish between Samsung and Apple products.

But the United States Patents and Trademark Office (USPTO) has this week invalidated the Apple patent covering this feature after an anonymous reconsideration request was filed earlier this year. Although it is not known exactly who filed this request, it is likely to be one of Apple’s competitors, with Samsung most likely being the company responsible. (However, after a barrage of lawsuits against various Android manufacturers, there are no shortage of tech companies who would love to see Apple lose many of its patents).

USPTO has rejected patent 7,469,381 on the grounds that there is already prior art for such a feature, and that Apple’s design does not involve any inventive steps upon this earlier implementation. USPTO has highlighted that such a design feature was found in an earlier patent for “controlling content display” filed by AOL and Luigi Lira in 2003, and also another patent for “continuous scrolling list with acceleration”, which ironically lists Apple boss Scott Forstall as one of the inventors.

The news that USPTO has overturned this patent, which was a key part of Apple’s victory over Samsung earlier this year, comes shortly after Californian judge Lucy Koh has begun considering a “Rule 50 motion” regarding the earlier court verdict. As the court verdict is being reconsidered, the invalidation of this particular patent could completely overturn the original jury decision, and mean that Samsung will no longer have to pay the $1 billion damages to Apple. This decision would also highlight the absurdity of many technology design patents which, rather than protection innovation, merely seem to move competition to the court room.

Samsung has already removed the “rubber band” feature from its US Android devices in response to Apple’s earlier court victory. Although the court injunction could be overturned and Samsung could reintroduce the feature it may just as easily omit the design from all future products, considering that it is probably not worth the potential trouble it has caused. SAMSUNG GALAXY S III MINI HEADS EUROPE

Samsung Company is set to reveal its Galaxy S III device tomorrow in Europe. From a 4.8-inch body, the handset has shrunk into 4 inches that will have similarity with the iPhone 5’s size. Reuters reported that the latest version will have its launch event in Europe and no words were thrown whether the smaller variety of Galaxy S III will reach the U.S or not. Although Samsung, the Apple’s rival company, didn’t tell important details on bringing the model in US, but it made confirmation on the device’s name: the Galaxy S III mini. JK Shin, head of Samsung Mobile Communications, told TechCrunch.com “GALAXY S III mini will come with 4’’ display and we are going to unveil the product tomorrow (October 11th).”

Engadget.com got some leaked info about the phone from MobileGeeks, the website says that the S III Mini may be a little bit more mid-range than the current model. The smaller version is expected to have a price of 399 euros or $510. Even the phone will have a 4-inch Super AMOLED display, the site suggests that it will only be having 800 x 480 which is a lowly pixel per inch rate of 233. It also points out that the S III’s quad-core Exynos processor will be replaced with an STE U8420 chip locked at 1 GHz. The phone will have 1GHz of RAM and 5-megapixel camera which is located at the device’s rear view.

The publication giant, Reuters, cited Shin, Samsung’s spokeswoman, saying: “We think there’s strong demand for 4-inch screen models in Europe.” The publication was also told that the Galaxy S III Mini would not be an entry-level model—contrary to the leaked info from MobileGeeks.
